Membership Terms & Conditions

General:

All ICA Memberships are for the member’s individual, personal use only.
When you start a Membership subscription online, you will receive your payment receipt immediately via email however it may take up to one week for your Membership to be activated. Once your Membership has been activated, you will receive a further confirmation email with instructions on how to access your online account. Your Membership will be valid for one year after receiving this confirmation email.
By joining as an ICA Member, you are entering a legal contract to commit to and to pay for a one-year Membership subscription. You can choose to pay for one year upfront, or to pay monthly in equal instalments. If you choose to pay monthly, you must ensure that the ICA can continue to collect your monthly payments.
On expiry of the initial one-year term, your Membership subscription will automatically renew, although you may cancel your Membership subscription at any time after you have made a full annual or twelve individual monthly payments. See ‘Cancellation’ below.
We may reasonably amend these terms and conditions at any time. You are bound to the current version of the Terms & Conditions, which is the version currently online at www.ica.art/terms-conditions
By joining as an ICA Member, you consent to the ICA sending you communications related to Membership administration, the ICA’s programme, activities and your benefits. Please refer to our Privacy Policy for further information.
Your statutory rights are not affected.

Automatic Renewal of your Membership Subscription:
If you elected to pay annually, you will receive a notification by email at least seven days before your Membership subscription is due to automatically renew and payment is due to be collected. If you wish to cancel your subscription after one year, you need to notify us by emailing membership@ica.art from the email address that we have on file for you at least three business days in advance of your renewal date to prevent us collecting your annual payment.
If you elected to pay monthly, your monthly payments will continue to be taken indefinitely unless you cancel your Membership subscription. If you wish to cancel your subscription after one year, you need to notify us by emailing membership@ica.art from the email address that we have on file for you at least three business days in advance of your renewal date to prevent us collecting your next monthly payment.
No refunds are offered after payments have been collected.

Membership Subscription Payment Method:
We use a subscription payment method called continuous authority, which means your subscription payments will be charged to the credit or debit card you provided when you purchased the Membership. We may not be able to collect your payment if the stored card details are no longer correct e.g. if your card expires.

If you elected to pay monthly, and we cannot collect any of the first 12 payments, you are liable to pay the missed payment(s) using an alternative payment method. If this happens, we will attempt to contact you and provide instructions to update your payment method and/or to pay the balance by an alternative means.
Within the first year, if we cannot contact you or you fail to update your payment details within 30 days, we will start recovery action against you to recover the payments due.

After one year has passed, if we cannot contact you or you fail to update your payment details within 30 days of the missed payment, you will be notified that your Membership subscription has been cancelled permanently, and all unused benefits will be lost.

Your Membership may be suspended during any time you are behind on payments.

Refunds are not offered if benefits are not used during the duration of the Membership, and the length of Membership will not be extended if Membership is suspended due to a missed payment. It is your responsibility to cancel your Membership subscription if you no longer wish to be an ICA Member, but if you elected to pay monthly, this can only be done after 12 payments have been successfully collected.

Legacy Direct Debit Members:
If you pay by direct debit, your payments will be collected on the 1st or 15th of the month, depending on your preferences when you joined.
We are unable to make changes to your direct debit collection dates or other direct debit arrangements. In 2020 we contacted all Members who pay by direct debit to request that they switch their payment method to continuous authority by updating their card details online, for which we have provided instructions.
Direct debit payments are protected by the Direct Debit Guarantee. Upon signing up you were sent a confirmation to the email address you have provided that includes the details of the Direct Debit Instruction. The Advance Notice will also be sent to this email at least 5 days prior to the first Direct Debit, please note that a follow-up Advance Notice will be sent only if the date, frequency, or amount of the Direct Debit changes from the original confirmation.

Changes to Membership Benefits and Pricing:
The ICA reviews Membership benefits regularly and reserves the right to change or amend the benefits available to Members at any time. The benefits that you are currently entitled to are listed in this policy at www.ica.art/terms-conditions
No refunds will be offered should ICA change or withdraw any Membership benefits.
The ICA reviews Membership pricing regularly to ensure that we remain competitive. Your Membership subscription prices may be changed at any time, including a routine pricing review taking place at the beginning of each financial year, (1 April). You will be given 10 days’ notice by email of any changes to pricing, which will then be applied to your next scheduled annual or monthly payment. If you do not wish to accept the change in price, you may cancel your Membership, provided you have paid for a full year. See “Cancellation”.
If you elected to pay monthly and have been a member for less than one year, any changes to pricing will be applied after you have made 12 payments at the price at which you joined.
No refunds will be offered for payments which have been collected regardless of the value of the payment, provided we gave you 10 days’ notice if the payment has been increased.

All Member benefits:
All ICA Members benefit from free exhibition entry at any time the ICA exhibitions are open. This also includes supplementary free events curated on a case-by-case basis.

ICA Members never pay an online or telephone ticket booking fee.

All Members may be asked to show photo ID alongside their complimentary ticket on entry to the ICA, or at the entrance to any of the auditoria.

Current Red Membership / Membership Benefits:
Red Members are entitled to one complimentary ticket to each ICA programme event (for film, one complimentary ticket per title), for their personal use. Red Members may also benefit from priority booking for some events including access to editions and merchandise in advance of the wider audience.
Red Members may bring one guest to each exhibition for free.
Tickets redeemed online or at the Box Office will be sent as an e-ticket to the email address used for Membership registration. When redeeming tickets at the Box Office, you must present your membership card. Paper tickets are available at the Box Office if required.
Red Members also benefit from a 10% discount at the ICA Bookstore and the ICA Bar.
Other promotional gifts and incentives may be offered to new Red Members from time to time, please visit www.ica.art/join for further information. Any such offers cannot be redeemed by those who are currently a Member at the time the offer is published.
Blue / Club / Concession members are eligible for 50% off on all tickets. This applies to one ticket per event. Tickets redeemed online or at the Box Office will be sent as an e-ticket to the email address used for Membership registration. When redeeming tickets at the Box Office, you must present your membership card. Paper tickets are available at the Box Office if required.

Complimentary Tickets:
Both memberships do not entitle you to a complimentary ticket for a guest, unless specifically stated on the event copy.
It is important that you let us know if you have booked a ticket but can no longer attend by emailing sales@ica.art at least one day prior to the start of the event. This is important for cinema scheduling as your membership only offers one discounted or free ticket per event. If a ticket is not cancelled in time, you will be charged for a second.

Cancellation:
You may cancel your Membership subscription at any time after you have made a full annual or twelve-monthly payments by emailing membership@ica.art
If you wish to cancel your subscription before it automatically renews, you need to notify us at least seven business days in advance of your renewal date to prevent us collecting your payment.
No refunds are offered after payments have been collected.
No refunds are offered for any unused benefits at the time of cancellation, including if the Membership has been cancelled by us under the terms of this agreement.

Notices:
Any notices we have sent to the latest email address you have provided to us at the time of writing will be deemed to have been successfully delivered.


Ticketing Terms & Conditions

Booking Fees:

A booking fee of £1 per ticket applies to all online and telephone bookings. This does not apply to ICA Members or to bookings made in person at the ICA.


Concessions:

The concessionary ticket rate applies to disabled visitors (whom may also request one additional complimentary companion’s ticket), visitors receiving income support, visitors under the age of 18 (where permitted) or over the age of 65, students with valid student ID and Westminster residents. You may be asked to show evidence of your entitlement to concessionary pricing when purchasing or collecting your ticket or entering an event.

The ICA is committed to ensuring equal access for all and has a limited number of complimentary tickets available for those who need them. If you cannot attend any ICA programme for financial reasons, please get in contact with us by emailing Melanie.Coles@ica.art for further information.

Exhibition Tickets are free to all concessions listed above with the exception of students. Students are not entitled to a concessionary rate for Exhibition Tickets.


Ticket Collection:

All tickets booked on the ICA website will emailed to you as an e-ticket which can be printed at home or displayed on your smartphone or tablet (recommended).

Tickets purchased over the telephone can be emailed to you as an e-ticket or collected physically from the box office. Tickets purchased in person at the box office are presented as physical tickets or can be emailed as an e-ticket on request.

E-tickets and tickets will be scanned at the point of entry to the event. You can show us your smartphone or tablet with the PDF visible for scanning. If you have booked concessionary rate tickets you may be asked to show evidence of your entitlement to concessionary pricing alongside your e-Ticket.


Ticket Return, Exchange and Resale:

For most ICA ticketed events, tickets may be returned to the Box Office no later than 24 hours prior to the start of the performance. Customers will be issued with a credit voucher for the full face value of the tickets, which can be used to purchase tickets for future events on sale via the Box Office. Credit vouchers are valid for one year from the date of issue. Please note that credit vouchers will automatically expire if not used within one year of the cancellation date. Tickets may not be resold for profit or commercial gain. Tickets that have been resold are void and will result in refused entry. This includes all tickets purchased through unauthorised third parties and online auction sites.

Tickets may not under any circumstances be altered, defaced or copied.

The ICA is not responsible for any additional costs incurred by the ticket holder such as travel or accommodation for any cancelled, rescheduled or amended events.

Tickets which have been returned are not valid for entry to events and will be flagged as void when scanned on entry.


Refunds for event tickets:

Refunds will only be issued in the event of a performance being cancelled or fundamentally changed. You will be contacted in the event of a performance being cancelled or if there is a major change to your chosen performance.

These is no refund value for complimentary tickets for Members or otherwise.


Group Bookings:

Group bookings can be made via the ICA website or you can contact the Box Office directly to arrange purchasing tickets on 0207 930 3647.

The Box Office opening hours are Tuesday – Sunday, 12pm – 9pm. The telephone booking line is open between 3pm and 6pm on these days.


Conditions of Entry

The ICA reserves the right to:

• Change the advertised arrangements of any event or screening due to illness or any cause beyond the control of the ICA.

• To refuse admission or to request that any visitor leave the venue, and to take the appropriate action to enforce this right.

Only tickets bought from the ICA Box Office, its official website or from approved agents will be valid for admission.


Event Recording and Filming:

By buying a ticket or attending an event at the ICA, you give your consent to being filmed, audio recorded or photographed. Should an event be recorded this will be signposted. If you have any objection then please make yourself known to a member of staff. Further details on what we do with the content filmed, recorded or photographed can be found in our privacy policy.


Latecomers:

The seating of latecomers is discretionary. Admission is not guaranteed for all events, though offered wherever possible. Please note the refunds or credit vouchers will not be issued for late entry. Uncollected concessionary tickets, whether ICA Members or otherwise, may be released five minutes before the start of any event where it is sold out.


Hires or Third Party Events:

The ICA sometimes hosts third party ticketed events or hires. The ICA is not responsible for any cancellations or changes to programme that may occur outside of its reasonable control. Third party hires or events may not be ticketed by the ICA therefore any enquiries regarding bookings must be directed to the point of purchase. The ICA reserves the right to refuse admission to the premises.


Personal Belongings:

Visitors are requested to keep their personal belongings with them at all times. The ICA is not responsible for any left or stolen property. Large bags and suitcases are not permitted into the Cinemas, Theatre or into events in other venues in the building. The ICA does not have a cloakroom so please do not bring such items with you, to avoid being refused admission to your event.


Lost Property:

The ICA is not responsible for any property left on the premises. The ICA will hold lost property items for one month before destroying the item if it contains personal information, or sending to a charity if the item does not contain personal information.


Photography, Audio or Film Recording:

Personal photography is permitted in all exhibitions, unless otherwise notified. Professional photography is not permitted unless prior consent is agreed, please contact us on 020 7930 3647 for further information.

Personal audio or video recording of any performance is prohibited.


Children:

Parents are reminded that not all events or exhibitions are suitable for children under the age of 18. Please check the relevant Event or Exhibition page for specific details before you attend.


Age Restrictions:

All Cinema screenings are over-18, unless rated differently by the British Board of Film Classification. This information is displayed on the web page for the particular screening. ID may be requested when purchasing a ticket at the box office, or at the entrance to the venue.

Admission for ICA Live programme and gigs is strictly for over 18s unless otherwise specified. Appropriate ID may be requested. In all cases where ID is requested, if valid ID is not produced, the ICA reserves the right to refuse admission.

Valid forms of ID are an international passport, UK driving licence or international identification card.
Cinema Exhibition Terms & Conditions

When a film is exhibited at the ICA, the terms are negotiated at the time of booking, and a percentage of the net box office revenue is agreed to the film’s distributor/rights holder.
For event partners, there is a standard allocation of 10 complimentary tickets for Cinema 1 events and 4 complimentary tickets for Cinema 2 events. Advance notice of use of the comp allocation must be given 48 hours in advance of the screening otherwise tickets will be released for public sale.
All screening materials must be delivered to the ICA projection department 14 days prior to the first screening event. Available screening formats are 35mm, 16mm, DCP, Prores File, Digibeta tape, Blu-ray. Box office sales reports will be supplied to the rights holder within 10 days of the screening event.
The ICA is a Registered Charity, Charity Number 236848. £1.20 from each ICA ticket sale is allocated directly as a contribution towards the Institute of Contemporary Arts’ public programme. The distributor/rights holder is agreeing to these terms at the time of booking.
Institute of Contemporary Arts (ICA) requires from all festival, media partners and external parties ('Licensor') in partnership and/or collaboration with the ICA to guarantee that they are the rights holder for the films and events, and the associated marketing materials thereof, that will take place at the ICA. The Licensor grants all necessary rights and licenses to the ICA to allow the ICA to screen the film, or host the event, and to market and promote the same and warrants that in doing so the ICA shall not be infringing the IPR of any party. The Licensor guarantees that each film and/or event they represent, and the associated marketing materials thereof, is protected by copyright and does not infringe the copyright or any other rights of any third party, and all necessary rights clearances and/or consents (including but not limited to actors, directors, writers, producers, music, footage, etc.) necessary to authorize the film or event to be publicly exhibited and promoted have been attained. The Licensor shall indemnify the ICA against all claims, damages, liabilities, losses, costs, reasonable fees (including legal fees) arising out of any screening or event held at the ICA due to copyright or rights clearance issues or disputes. These terms and conditions shall be governed by UK law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.


Bookstore and Artists’ Editions Terms & Conditions

We can accept payment by Visa, Mastercard, Solo and Maestro. (Unfortunately, we do not accept payment by American Express.)

For Editions, we may offer invoicing and payment plan options. By committing to this option, please note that you are entering into an agreement with ICA thereby committing to purchasing the work. If we agree that you may pay in instalments, all payments made will be viewed as a non-refundable deposit placed on holding the Edition until payment is completed. Should you decide not to complete the purchase, payments already made are not refundable. Contact editions@ica.art for further information.


Collection and Postage:

You can collect your Bookstore purchase from the ICA Bookstore without appointment Tuesday – Friday 12pm – 9pm, although if you are making a large collection, please let us know to expect you by emailing sales@ica.art.

Please make an appointment to collect an Edition by emailing editions@ica.art. You may only collect Editions which are paid for in full. Editions are fully condition checked before dispatch/preparing for collection, and on collection you will be required to sign for your purchase, agreeing that it was collected in good condition.

If you purchase a delivery option, please allow:
UK, 2 – 3 days working days.
Europe, 3 – 5 days working days.
Rest of the World, 7 – 14 days working days.

Postage times may be affected by situations outside of our control. If this happens we will endeavour to keep you informed of revised postage times.

We will deliver your items to the delivery address which you supply when you place your order. All delivery times quoted are estimates only, based on availability, normal processing and delivery time.


Damage:

We are very sorry if you receive your item in a damaged condition. We always condition check items when we dispatch them, but unfortunately damage in transit can occur.

If your parcel arrives obviously damaged, please do not sign for it and ask the courier to return to sender.

When buying an Edition, please thoroughly condition check on receipt and inform us of any defects by emailing editions@ica.art within 48 hours of receipt. We will consider your claim and where we determine that this damage was caused before you signed for the item we will exchange it for another of the same Edition or offer a refund only where there is no further stock available. In this scenario, please speak to us about organising return of the Edition free of charge. 


Storage:

When purchasing an Edition and selecting the collect from ICA option, please note we can offer 4 weeks’ worth of free storage for large Editions (then £20 per week) and 6 weeks for small Editions (then £5 per week), unless we agree special terms with you at the point of purchase. Please email editions@ica.art with any questions regarding storage and collection.

Storage fees do not apply when we have told you that you are currently unable to collect an Edition due to delays in receiving or preparing stock or access restrictions.


Returns Policy (excluding Artists’ Editions):

Any unwanted goods must be returned including a receipt as proof of purchase and be in resaleable condition. We reserve the right to refuse to refund any item that it is not in a good resaleable condition. We cannot authorise a refund for any goods without proof of purchase.

In cases of goods that are faulty, damaged or incorrectly supplied, please contact editions@ica.art to organise returning the goods to the Bookstore. Where you cannot return goods in person, we recommend that you use registered post or recorded delivery to return goods to us to ensure safe delivery.

The Bookstore shall use reasonable efforts to replace damaged or incorrect goods, but if replacement is not possible, or if an order is cancelled for any other reason, we will only be obliged to refund the full amount paid by you. This does not affect your statutory rights.


Artists’ Editions:

Please note that by purchasing an Edition you are agreeing to our Additional Terms & Conditions of Sale as listed on this webpage.

Please note that prices are subject to change. As is traditional in Edition publishing, prices may rise as an Edition begins to sell out.

All Editions sales are final and we are unable to offer refunds if you change your mind.

Additional Terms & Conditions for Sale of Limited Editions (‘Artwork’)

1. Introduction These terms & conditions (‘Terms & Conditions’) apply to the sale to you by the Institute of Contemporary Arts (ICA) of any limited edition print or any other piece of artwork (the ‘Artwork’) by any artist (the ‘Artist’) either at the ICA’s premises or through its website.

2. Title and Risk As soon as the purchase price is paid in full, you will become the legal owner of the Artwork and, upon such payment, you will be responsible for the Artwork and the risk of damage to or loss of the Artwork will pass to you.

3. Ownership of the Artwork Copyright

3.1. The Artwork was specially commissioned in conjunction with the exhibition of work by the Artist and the ICA. The Artist has worked closely with the ICA to produce the Artwork on the strict understanding that it will be available for purchase exclusively through the ICA or any other outlet approved by the ICA. It is the Artist’s expectation that the Artwork will not be purchased for resale and will be retained by you for your own personal enjoyment. Specifically, you may not sell or offer for sale the Artwork on any internet based auction or other website.

3.2. Copyright of the Artwork remains the property of the Artist.

3.3. You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose.

3.4. If you breach any of your obligations under paragraph 3.3 you agree that:

a) The payment of damages will not be a sufficient remedy to compensate us or the Artist for your breach;

b) We may, and the Artist may, apply to the court for an order to prevent you from continuing to breach your obligations under these Terms & Conditions; and

c) We may, and the Artist may, contact the operation of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operation, on your behalf, to remove any such offer for sale or image from any such internet website.

4. General Data Protection Regulations (GDPR)

Under the EU General Data Protection Regulations (GDPR), with your consent, we may collect, hold and use your personal data obtained from you in the course of your purchase of the Artwork. This personal data will be used strictly for the purposes of administering the sale of the artwork to you, for our financial records, for historic records to show which Edition has been sold to which individual, and to be disclosed to the Artist if you breach your obligations under these terms & conditions. Your consent to us collecting, holding and using this personal data will be obtained as part of the paperwork for purchasing an Artwork. Your personal data will only be accessible to the ICA Staff responsible for the sale of the ICA Editions and the ICA Finance team for the purpose of invoicing. Any financial information like invoices will need to be stored for the statutory designated period and your personal data might form part of this information. We also store records of Artwork sales for the purposes of our Archive. If you would not like your data to be part of the Archive, please do let us know when filling out the paperwork for purchasing an Artwork.

If at any point you believe the information we hold on you is incorrect, you can request to see this information and even have it corrected, deleted or anonymised. Your point of contact at any point in time to update, change or query the data we hold on you is the ICA staff member responsible for the sale of Editions.

5. Liability of the ICA

We make no representation or warranty of any kind whatsoever, express or implied, in connection with the Artwork. The ICA and its staff, shareholders or agents exclude all liability (whether in contact, tort or otherwise), to the fullest extent permitted by applicable law, for any loss or damage that may result to you or a third party in connection with the Artwork.

6. Rights of Third Parties

No person other than you and the ICA have any rights under these Terms & Conditions other than in respect of paragraph 3 above which confers a benefit on the Artist and is intended to be enforceable by the Artist.

7. Governing Law and Jurisdiction


These Terms & Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.

ICA Bar Terms & Conditions

Entry to the Bar may be restricted for certain special events. Entry to the Bar for those under the age of 18 is restricted after 9pm (you must be accompanied by an adult and not visit the bar area).

Drinks purchased at the Bar may only be consumed within the Bar area, unless decanted into non-glass cups for consumption in the Cinemas or some performances in the Theatre. Drinks are not permitted in the Galleries, and you may not remove drinks from the premises.

You must be over 18 to purchase alcoholic drinks from the Bar. We operate a challenge 21 policy and photographic ID may be requested.

Please respect our neighbours by always leaving the premises quietly.
